By accessing or using the Platform, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are registering on behalf of a business, you confirm that you have the authority to bind that business to these Terms.
We reserve the right to update these Terms at any time. Continued use of the Platform after any changes constitutes acceptance of the revised Terms.
The Platform provides a white-label digital loyalty stamp card service that enables Businesses to run loyalty programmes and Customers to collect stamps and earn rewards. Services include:
We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.
Businesses must register an account and be activated by a platform administrator before their loyalty programme goes live. By registering, you agree to:
We reserve the right to suspend or terminate any Business account that violates these Terms or engages in fraudulent activity.
Customers may collect stamps without creating an account. However, creating a free account allows stamps to be tracked across devices and sessions. Customer accounts are personal and may not be shared or transferred.
Customers are responsible for the accuracy of their registration information. Stamps collected under guest sessions may be linked to a Customer account upon registration.
Access to the Platform requires a paid monthly subscription. Current plans are:
All prices are exclusive of VAT. Subscriptions are billed monthly and are non-refundable except as required by applicable law. We reserve the right to change subscription pricing with 30 days' written notice.
Failure to pay subscription fees may result in suspension of your account. Suspended accounts retain their data for 30 days before permanent deletion.
Each Voucher Code is single-use. Once redeemed for a Stamp, the code cannot be used again. Businesses are responsible for the secure distribution of Voucher Codes.
The Platform does not guarantee the physical delivery of Voucher Codes to Customers — this is the responsibility of the Business. We are not liable for lost, stolen, or misused Voucher Codes.
Stamps are non-transferable between businesses and cannot be converted to cash or any other value.
Rewards are defined by each Business and are fulfilled entirely at the Business's discretion. The Platform facilitates the tracking and notification of Rewards but does not guarantee their fulfilment.
BDM accepts no liability for a Business's failure to honour earned Rewards. Disputes regarding Rewards should be directed to the relevant Business.
Rewards have no cash value and may not be exchanged for money.
You may not use the Platform to:
Violation of this clause may result in immediate account termination without refund.
All intellectual property in the Platform, including software, design, branding, and content, is owned by or licensed to BDM. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for its intended purpose.
You retain ownership of your business data and customer data. By using the Platform, you grant BDM a licence to process this data as necessary to provide the Services.
To the maximum extent permitted by law, BDM shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of revenue, loss of data, or business interruption.
Our total liability to you for any claim arising from these Terms shall not exceed the total subscription fees paid by you in the 3 months preceding the claim.
The Platform is provided "as is" and we make no warranties, express or implied, regarding its availability, accuracy, or fitness for a particular purpose.
Either party may terminate a Business account at any time by providing written notice. Upon termination:
We may terminate your account immediately for material breach of these Terms, fraudulent activity, or non-payment.
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.
The Consumer Protection Act 68 of 2008 and the Protection of Personal Information Act 4 of 2013 apply where relevant.
